Terms and Conditions

The general conditions of the Dacomap online store are drawn up in accordance with the Consumer Protection Act (ZVPot), the Personal Data Protection Act (ZVOP-1), the EU General Data Protection Regulation (GDPR) and the Electronic Communications Act (ZEKom-1).

With the Dacomap online store (hereinafter also “online store”), which is managed by the company Damir Hamulić s.p., Kalanova ulica 1, 1215 Medvode, which is also a provider of electronic business services (hereinafter also “provider”).

We advise you to carefully read the Terms of Business listed below before using the online store. The buyer is bound by the general conditions valid at the time of purchase, i.e. submitting an online order. When placing an order, the buyer is each time specifically reminded of the general terms and conditions of business and confirms his familiarity with them by placing the order.

1.Availability of information
The provider undertakes to always provide the customer with the following information:

  1. identity
  2. contact addresses that enable fast and efficient communication (e-mail, telephone),
  3. essential characteristics of goods or services (including after-sales services and guarantees),
  4. product availability (every product or service offered on the website should be available within a reasonable time)
  5. conditions of product delivery or service performance (method, place and deadline of delivery),
  6. all prices must be clearly and unequivocally determined and it must be clearly shown whether they already include taxes and transport costs,
  7. method of payment and delivery,
  8. time validity of the offer, the period within which it is still possible to withdraw from the contract and the conditions for withdrawal,
  9. in addition, also about if and how much it costs the customer to return the product,
  10. explanation of the complaint procedure, including all information to the contact person or customer service department.

2.Prices
All prices are expressed in EUR and include value added tax (VAT). The prices published at the time of placing the order apply.

3.The order
The sales contract between the provider and the buyer is concluded in the online store at the moment when the provider sends the buyer the first e-mail confirming his order. From this moment, all prices and other conditions are fixed and apply to both the provider and the buyer.

The purchase agreement (i.e. the first electronic message about the status of the order) is stored electronically on the provider’s server and is available to consumers upon their written request.

4.Payment methods
The Dacomap online store allows the following payment methods:

– by pre-invoice (UPN order) to the company’s account

– in cash upon personal collection

5.Issuance of an invoice
After delivery and payment of the ordered items, the provider also sends the customer an invoice in pdf format to the customer’s e-mail address. The price and all costs related to the purchase are detailed on the invoice. The buyer is obliged to check the correctness of the data before placing the order.

6.Purchase process
To purchase a product, fill in your information (mandatory) and any additional wishes for the picture (frame or/and colored ) on the ‘order’ subpage. After entering the customer’s information, press send and within 24 hours you will receive an email with a UPN order.

7.The right to withdraw from the contract
The buyer (applies exclusively to natural persons who acquire goods for purposes outside of their business activities) has, in accordance with Article 43. Article ZVPot the right to notify the provider within 14 days of receiving the ordered goods that it withdraws from the contract, without having to give a reason for its decision. The deadline starts counting one day after the date of collection of the items.

The buyer must return the goods no later than 14 days after notifying the provider of withdrawal from the contract. The buyer is considered to have returned the goods on time if they are sent before the expiry of the 14-day period. The buyer must return the goods to the address: Damir Hamulić s.p., Kalanova ulica 1, 1225 Medvode, Slovenia.

The buyer must return the item to the provider undamaged and in the same quantity, unless the item is destroyed, damaged, lost or its quantity has decreased through no fault of the buyer. The buyer may inspect and test the items to the extent necessary to determine the actual condition. The buyer is responsible for a reduction in the value of the goods, if the reduction is the result of conduct that is not absolutely necessary to determine the nature, properties and functioning of the goods.

In case of withdrawal from the contract, the buyer only covers the costs of returning the goods. In the case of sales contracts, the provider may withhold the refund of the received payments until the returned goods have been accepted or until the buyer provides proof that he has sent the goods back, unless the provider offers the possibility to collect the returned goods himself.

The buyer does not have the right to withdraw from the contract for contracts, the subject of which is an item that has been manufactured according to the buyer’s exact instructions, that has been adapted to his personal needs, that due to its nature is not suitable for return, that is perishable or that has already expired best before.

Payments made will be refunded as soon as possible, but no later than within 14 days of receiving the notice of withdrawal from the contract. The provider returns the received payments to the buyer with the same means of payment that the buyer used, unless the buyer explicitly requested the use of a different payment method and if the buyer does not bear any costs as a result.

In exceptional cases, when the items are not returned in accordance with the ZVPot, the provider can offer the buyer the purchase of the item with appropriate compensation, which the provider will determine in the minutes upon return. The purchase with a reduced value is taken into account upon confirmation of the buyer by e-mail. The buyer benefits from the aforementioned redemption fee only when ordering another item of the same or higher value.

8.Complaints
If the delivered products differ from the ordered products or if products were delivered that were not the subject of the order, the buyer can notify the provider at the email address dacomap.com, and return the delivered products in accordance with the agreement. In the event of a recognized complaint, the provider will replace the mentioned products with suitable ones free of charge.

9.Delivery
The product will be sent via the Post Office of Slovenia, whereby the provider reserves the right to choose another delivery service in order to carry out the order more efficiently. The amount of delivery is included in the price of the product.

The provider offers the possibility of personal collection.

10.Security of purchase
The provider uses appropriate technological and organizational means to protect the transfer and storage of personal data and payments.

11.Protection of personal data

12.Limitation of liability
The provider makes every effort to ensure that the information published on its pages is up-to-date and correct. Nevertheless, the characteristics of the items, the delivery time or the price can change so quickly that the provider fails to correct the information on the web pages. In such a case, the provider will inform the customer about the changes and allow him to withdraw from the order or exchange the ordered item. Although the provider tries to provide accurate photos of the items for sale, all photos should be taken as symbolic. Photos do not guarantee product features.

The provider may withdraw from the contract in the event of an obvious error in accordance with Article 46 of the OZ. An obvious error is considered to be an error in the essential properties of the item and all data that are considered decisive for the purchase of the item and which the provider would not have confirmed or entered into a contract with such content if he had known. An error in the price in the event of a material mistake is also considered an obvious error.

13.Legal notice
The Dacomap online store and all information on it, images of articles, graphic and video elements on the website are protected and may not be reproduced or used without prior written permission.

14.Complaints and disputes
The provider complies with the applicable European legislation on consumer protection. The provider makes every effort to fulfill its duty to establish an efficient system for dealing with complaints and to designate a person with whom, in case of problems, the buyer can contact by phone or e-mail.

In case of complaints, disputes, problems, the buyer can contact the provider on the telephone number 031/771-025 or by e-mail at info@dacomap.com. Complaints are submitted via the email address info@dacomap.com. The complaint handling procedure is confidential.

The provider is aware that an essential characteristic of a consumer dispute, at least as far as judicial resolution is concerned, is its disproportion between the economic value of the claim and the costs incurred in resolving the dispute itself. This is also the main obstacle for the buyer not to initiate a dispute before the court. Therefore, the provider makes every effort to resolve any disputes amicably.

In the case of judicial settlement of disputes, the court of the buyer’s permanent residence is competent.

15.Out-of-court settlement of consumer disputes
In accordance with legal norms, the provider does not recognize any provider of out-of-court resolution of consumer disputes as competent for the resolution of a consumer dispute that the buyer could initiate in accordance with the Act on Out-of-Court Resolution of Consumer Disputes.

Dacomap, which as a provider of goods and services enables online trade in the territory of Slovenia, publishes on its website an electronic link to the platform for the online resolution of consumer disputes (SRPS), which is available to consumers (https://ec.europa.eu/consumers /stage/)
